This message is essential and must be read by customers purchasing a ticket to attend OUR EVENTS. The customer shall read, understand and agree to accept the terms and conditions below before buying a ticket to attend OUR EVENTS.. By purchasing a ticket to OUR EVENTS, the customer agrees they have accepted and agreed to the following terms and conditions.

DEFINITION

“Ticket” means any valid ticket that permits a customer, who buys it through selling channels, to have the admission right into OUR EVENTS (“The Event”) or any valid wristband for which the customer has exchanged the ticket upon entry. In addition to the general entrance ticket and/or wristband, some additional or “top-up” ticket/wristband may be required to attend a specific performance, and the customer may pre-buy or top-up the value of Ticket/wristband at the counter service at the Event for such additional or extra activities.

Tickets to the Event are sold by and on behalf of Good Hearts Agency, (“the Organizer”), who reserve the right to change all or any arrangements concerning the Event without notice, nor with any obligation whatsoever to refund.

 

In the event you are obtaining tickets for or providing any tickets to any other person or persons, you recognize that you are acting as that person’s agent in obtaining the tickets, and due to this agency relationship you agree to these terms and conditions on behalf of any person to whom you deliver any of the tickets you purchase, and you shall notify any such person of these terms and conditions when you deliver a ticket to them. It is considered that the Ticket holder receiving the Ticket from you agrees to these terms and conditions as well.

 

“The Event” means the event that we host and operate, which is held at the venue in respect of which the customer has bought the Ticket.

 

“Venue” means the venue where the Event is held.

 

“The Organizer” means Good Hearts Agency who produces and operates the Event.

TICKET USE

The Ticket entitles the holder to admission to the event, performances and activities on-site. Performances and activities vary, may be subject to additional charges and may change without prior notice.

 

You must retain your Ticket/wristband at all times during the Event. Photo ID may be required and verification is at the discretion of gate staff.

 

You agree that the Ticket is a revocable license, which is subject to revocation and/or denial of admission of the Organizer without compensation, for any reason including but not limited to your attempted or actual violation of any applicable laws or promoter or venue rules, policies or regulations.

 

The Organizer has technical procedures in place that are capable of detecting any photocopied or forged ticket. The Organizer shall be entitled to refuse admission to the holder of any ticket in which irregularities are detected at the Organizer’s sole discretion. The detection of any fraudulent use of the Print @ home tool will be prosecuted in accordance with the applicable legislation, including criminal liability.

 

In the event of any breach of these terms and conditions, the Organizer, its staff and agents reserves the right to cancel tickets, to refuse admission, to remove the holder, or to confiscate offending articles, as the case may be, and in any case to retain any monies paid for the relevant ticket(s).

 

By your use of the Ticket for entry to the Event you acknowledge that you have read these terms including the waivers and releases of liability contained herein and you fully understand its terms, and you understand that you have given up substantial rights, knowingly and voluntarily without any inducement or duress.

 

Any attendee, including after entry to the Event site, may be ejected without any entitlement to a refund, as a result of failing to follow instructions given by the Organizers or their staff, causing a disturbance, carrying or consuming drugs, or due to an apparent or potential state of intoxication, and will be personally and fully responsible for their own actions and omissions towards third parties and damage to objects.

LIABILITY

You agree that the Organizer shall not be held responsible, financially or otherwise, for any personal property that is left, lost, stolen, destroyed, confiscated, damaged or misplaced anywhere on site or during the event, regardless of fault or reason.

 

You agree that certain content of the Event is intended for mature audiences only. You agree that the Organizer reserves all rights to cancel, postpone, and/or change the venue, the artist lineup, time, and/or date of the event for which the Ticket was issued at any time without prior notice or compensation to you.

 

Persons entering the Event hereby consent to having names, images and/or likeness, writing, biographical information or recordings of their voices captured or reproduced in any medium, forever and throughout the world, for editorial, educational, promotional, publicity, advertising or any other purpose by Good Hearts Agency, or its affiliates, respective successors and assigns, contractors, partners or the media.

 

The Organizer reserves the right to limit access to any stage to prevent hazardous overcrowding.

 

You agree that Good Hearts Agency its servants or agents will not be liable for any loss, injury or damage to any person (including yourself) or property however caused (including by the organizer or its servants or agents): (a) in any circumstances unless due to the negligence of Good Hearts Agency, its servants or agents; (b) in circumstances where such loss or damage is not a reasonably foreseeable result of any such breach (save for death or personal injury due to the negligence of Good Hearts Agency, its servants or agents); and/or (c) to the extent that any increase in any loss or damage results from the breach by you of any of these terms and conditions.

 

For the purposes of these terms and conditions, “Force Majeure” means any cause beyond Good Hearts Agency’s control including, without limitation, an act of God, war, insurrection, riot, civil disturbances, acts of terrorism, fire, explosion, flood, National Ceremony, theft of essential equipment, malicious damage, strike, lock out, weather, third party injunction, national defense requirements and/or acts or regulations of national or local governments. Good Hearts Agency will not be liable to you for failure to perform any obligation under these terms and conditions to the extent that the failure is caused by Force Majeure.

 

You agree that the Organizer shall not be liable to you for any indirect or consequential costs, claims, actual or alleged losses howsoever arising out of or in connection with the event and/or our obligations here under including, but not limited to, loss of profits, anticipated profits, savings, business or opportunity, or loss of publicity or loss of reputation, or opportunity to enhance reputation, or loss of contract or other economic or consequential loss arising from the performance (or any failure to perform) these terms and conditions.

 

The Organizer shall not have any liability to you whatsoever for loss or expenses incurred in connection with the event or any cancellation of the event, including, without limitation, costs of any personal travel, accommodation or hospitality arrangements made relating to the event or the cancellation of the event.

 

The Organizer shall not be liable for the acts or omissions of the operators of the venues, for any personal injury suffered at a venue (unless due to the act or omissions of Good Hearts Agency) or any loss, theft or damage to your property at a venue (unless due to the act or omissions of the Organizer) or caused by any property of the Organizer.

 

The Organizer, OUR EVENTS and our official agents can accept no responsibility for any personal property. Please do not bring unnecessary valuable items or excessive amounts of cash, as cashless payments and ATMs are available on site.

IMAGE AND SOUND RECORDING

The performers and/or Organiser is for commercial purposes authorised to make or arrange for image and/or sound recordings to be made of the Event and the Visitors to the Event and to reproduce and/or publicise or arrange for the publication of these recordings in any form and in any manner. By obtaining a Ticket to the Event and/or entering the Event venue, the Visitor unconditionally consents to the mentioned recordings being made and to the processing, publication and use thereof, in the broadest sense, without the Organiser or any of its affiliated companies being liable to pay any compensation to him at any time.

FORCE MAJEURE

In case of force majeure in the broadest sense, which in this regard also includes the illness and/or withdrawal of the artist(s), strikes, terrorist threat, decision to cancel by the competent authority, fire, bad weather conditions, etc., the Organiser will be entitled to move the Event to another date or location or to cancel the Event. 

 

The Organiser will not be responsible for damage arising from moving or cancelling the Event, as referred to above. If the Event is moved or cancelled, as referred to above, the Organiser will publicise this fact as far as possible in the manner that it deems appropriate, including among others through mentioning the applicable terms for a refund on the Website. The Organiser is only obliged in case of full cancellation to refund the admission fee as mentioned on the Ticket, but not the service fees and any incurred travel and accommodation costs, to the Visitor at his request. This applies in the event the Ticket was bought by the Visitor at the authorized (pre)sale addresses of the Organiser, and is not applicable in the event the Visitor bought the Ticket at any other sales platform, including but not limited to online secondary ticket marketplaces. 

 

The (partial) refund will only be made, within a reasonable period after the date of the cancelled Event, if the Visitor produces a valid, undamaged Ticket which proves that it was bought by the Visitor, in the manner stipulated and announced by the Organiser (or the party that processed the Ticket payment) by means of channels that it will announce. 

 

In the event the Event has to be cancelled due to or in connection with force majeure, the Organiser will be required to refund only a part of the fee as specified on the Ticket, or, failing that, only a part of the amount of the Ticket that the Visitor has paid via the authorized (pre)sale addresses. Service fees or other damages will not be refunded. Neither is the Visitor able to claim (replacement) access to a different event. 1

 

In the event the Event is rescheduled by the Organiser due to force majeure, the Ticket will remain valid for the new date that the Event is moved to. If the Visitor is not able to attend the Event on the new date, he is entitled to submit his Ticket at the (pre) sale address against refund of the amount of the Ticket (excluding service fees) that the Visitor has paid via the authorized (pre)sale addresses. This refund will only take place if the Visitor is able to deliver a valid and undamaged Ticket on time to the (pre)sale address, as specified on the Website.

 

The buyer or visitor is not entitled to a refund of his/her purchase price if the buyer himself or one of the visitors for whom the buyer buys a ticket (and/or other product) is not vaccinated, has not recovered from Covid-19 within 6 months before start of the event, or can’t present a negative test for entry, if or a then different condition required by government measures to gain entry to this event.

OTHER POLICIES

“Site rules” apply to camping areas, which include personal conduct – such as acceptable noise levels, management of waste and adherence to health and safety regulations and ELAN  “Rules of the Land” as outlined on the website.

Site rules shall be observed. The Organizer reserves the right to eject individuals or groups either disobeying the site rules or displaying antisocial behavior at the Organizer’s sole discretion without refund.

 

ELAN and Good Hearts Agency have a no drugs policy and reserve the right to eject anyone suspected of infringement of this policy.

  • No outside food and drink is allowed into the event site; you agree to bag searches between campsites and festival grounds and that any prohibited food or drink will be confiscated.

  • No outside alcohol allowed anywhere on site including camping areas. Vehicles may be searched upon entry and any alcohol will be confiscated.

  • Cooking or building fires is strictly prohibited; any cooking equipment found in possession of guests will be confiscated at the main entrance.

The Organiser reserves the right to refuse specific people entry or further access to the Event or to remove them from the Event and/or hand the Visitor over to the police if it deems this necessary for maintaining public order and safety during the Event and/or there is a violation of an article from these General Terms and Conditions. This also applies if a Visitor wears or carries clothing, texts or signs which, in the opinion of the Organiser, may be offensive, discriminating, insulting to or cause aggression or unrest among other Visitors or does not comply with dress code as specified by the Organiser, as well as to undressing during the Event (including but not limited, for instance, to exposing the upper part of the body). Even if a Ticket is likely to be counterfeit, the Organiser is entitled to refuse to admit the holder of this Ticket to the event without the Visitor or this holder being able to claim any compensation for any loss that this may cause him or restitution of the amount of the Ticket.

It is possible that exposure to loud music may cause damage to hearing, please bring your own ear protection.

 

Please be aware that lighting effects including strobe lighting may be used.

It is the responsibility of attendees to check gate opening and closing times – which will be published on the website and may change without notice. Ticket holders will not be admitted outside of these times.

 

The Organizer stores your data when purchasing tickets. This data will be treated in accordance with our privacy policy and will not under any circumstances be given to a third party. We may contact you with ELAN related news.

 

For safety reasons the Organizer reserves the right to:

  • Interrupt or stop the festival.

  • Provisionally keep the festival visitors on the site at the end of the festival.

  • Totally or partially vacate the site.

  • Deny access to the site regardless of the possession of a valid entry ticket.

  • Alter the program or the timetable of the festival. In this case the entry ticket remains valid and is neither exchangeable nor refundable.

We process all customer data following Vietnam's Personal Data (Privacy) Ordinance. We will never sell, share or use any personal information you provide to us for any purpose other than communicating with you about products, bookings or invitations come to our events. We may share information with government agencies or other companies that assist us in fraud prevention or investigations. We may do so when: (1) permitted or required by law; (2) attempt to protect against or prevent actual or potential fraud or unauthorized transactions; (3) investigate that fraud has occurred. The information is not provided to these companies for marketing purposes. Your personal information is kept securely. Only authorized employees, agents and contractors (who have agreed to keep information secure and confidential) have access to this information. All emails and newsletters from this site allow you to opt out of further mailings.

Please read the ticket policy before purchasing tickets on our site.

PAYMENT POLICY

Please make payment for your purchased tickets within two (2) days of reservation. All tickets must be paid and processed - the customer will receive a confirmation through their email. Only valid tickets accepted at the gate.

TICKET DELIVERY

All of our tickets are electronic tickets with a QR code for confirmation. The tickets will be included in an attachment sent to your email. Please get in touch with our hotline or email support@dancewithelan.com if you have any questions or problems receiving your tickets.
